reorganization proceedings must be the creditors of monetary debt whose the cause of debt arose prior to the date that the Central Bankruptcy Court issued an order for THAI’s business reorganization, irrespective of whether the debt is due or not. This includes trade debt, rent, debentures, etc. In this regard, the creditors must prepare information relating to the amount of debt which is calculated until the date that the Court issued an order for business reorganization and appointment of planners and the identity verification documents, as follows.​​

สำนักงานคณะกรรมการกำกับหลักทรัพย์และตลาดหลักทรัพย์ (ก.ล.ต.) จึงมีแนวคิดจะปรับปรุงหลักเกณฑ์การกำกับดูแลหุ้นกู้ด้อยสิทธิที่มีลักษณะคล้ายทุนเพื่อเพิ่มการคุ้มครองผู้ลงทุนมากขึ้นและยังสามารถพัฒนาตลาดตราสารหนี้ไปพร้อมกัน โดยกำหนดให้หุ้นกู้ประเภทดังกล่าวที่จะเสนอขายต่อผู้ลงทุนทั่วไปและผู้ลงทุนรายใหญ่ต้องได้รับการจัดอันดับความน่าเชื่อถือในระดับลงทุน (investment grade) เท่านั้น ซึ่งเป็นการคัดกรองคุณภาพในเบื้องต้นว่าบริษัทผู้ออกหุ้นกู้มีความสามารถในการชำระหนี้ระดับหนึ่ง เนื่องจากหุ้นกู้ดังกล่าวไม่มีการกำหนดอายุไถ่ถอน ทำให้ผู้ลงทุนอาจต้องถือไว้นานกว่าหุ้นกู้ทั่วไป
